Dog Bites/Animal Attacks
Dog bites and animal attacks happen more frequently than one might imagine. In fact, it has been estimated that more than 4 million people are attacked by dogs each year. More than three quarters of a million people in this country seek medical care and attention each year for injuries sustained in a dog attack. Many of those individuals require medical care and treatment in a hospital emergency room.
How is Liability Determined in a Oregon Dog Bite Case
Oregon has a strict liability dog bite statute that holds that the owners and keepers of dogs are responsible for the injuries and damages caused by their dog with very few exceptions. Oregon’s dog bite statute states:
" if any dog does any damage to either the body or property of another person, the owner or keeper, or, if the owner or keeper is a minor, the parent or guardian of such minor, shall be liable for such damage, except when such damage has been occasioned to the body or property of a person who, at the time such damage was sustained, was committing a trespass or other tort, or was teasing, tormenting or abusing such dog.”
In other words, you will not have to show that the owner or keeper of the dog that bit you knew that the dog was dangerous or has previously bitten another person. In certain cases you can even be bitten on the property of the owner of the dog and still recover money damages.
What Should I Do if I Have Been Bitten by a Dog in OR
If you have been bitten by a dog in Oregon you should do at least the following:
Call 911-the police or dog warden should come to the attack site to get all of the proper information and conduct an investigation as to the facts of the case, the owner of the dog, the dog involved and whether or not the dog is up-to-date on its rabies shots
Get immediate medical care and attention-one of the greatest risks that you have in a dog bite case is getting a serious infection from the dog’s teeth penetrating your skin and inserting bacteria into your body
Wait for a plastic surgeon to stitch any significant wounds-if you have any large wounds, deep wounds, complicated wounds or wounds that will cause some type of cosmetic injury you should not allow the resident doctor in the emergency room to stitch you up. You should instead wait until a plastic surgeon is contacted and comes to the hospital to take care of this very important procedure
